The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Manpur P.S. Case no. 33 of 2020 instituted for the offence under Sections 147, 149, 341, 323, 307, 325, 504, 506 of the Indian Penal Code.

It is a case of assaulting. It is alleged that when the informant and his father carrying wheat husk from his field then a dispute arose between Deepak Paswan and Ranjan Paswan. When the informant's father went to pacify the matter, they were assaulted him by lathi, sticks and iron rod which causes fracture injury in the hand of the informant's father. Learned counsel appearing on behalf of the petitioner

Patna High Court CR. MISC. No.44828 of 2022(2) dt.14-12-2022 2/2 has submitted that petitioner is innocent and has committed no offence. He has got no criminal antecedent. It is submitted that injury sustained by the injured person is simple in nature. There is case and counter case. Both parties have sustained injuries in the alleged incident.

Learned APP appearing for the State has opposed the prayer of Bail.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Manpur P.S. Case no. 33 of 2020, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- V, Nalanda subject to the conditions as laid down under section 438(2) of the Cr.P.C.
