The petitioners apprehend their arrest in connection with Sakra P.S. Case no. 216 of 2015, registered under Sections 304(B), 201 and 34 of the Indian Penal Code.
The accusation is of killing of the daughter of the informant by her husband and other in-laws due to non-fulfillment of demand of motorcycle and golden chain and thereafter her dead body was recovered from Gandak river in village Mahamada. Learned counsel for the petitioners submits that petitioner No.1 is mother-in-law and petitioner No.2 is brother-in-law of the deceased, daughter of the informant. Further submission is that, in fact, Santosh Kumar, husband of the deceased Sony Kumari, who used to
Patna High Court Cr.Misc. No.25743 of 2016 (3) dt.09-01-2017 2/2 reside separately in village Balua and petitioners have no concerned with them, but due to ulterior motive, the petitioners, who are motherin-law and brother-in-law have falsely been implicated in this case. The petitioners have no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur in connection with Sakra P.S. Case No. 216 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
