JUSTICE ARVIND SRIVASTAVA ORAL ORDER 19-01-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in Lakhisarai P.S.Case No.215/16 for the offences under Sections 147, 148, 149, 447, 323, 324, 325, 326, 370 of the I.P.C. and Section 27 of the Arms Act.

The accusation against the petitioner is of assaulting the informant along with other co-accused persons. Submission of the petitioner is that there is general and omnibus allegation of assault to the informant. He further submits that similarly situated co-accused have already been extended the privilege of anticipatory bail by this Court vide orders dated 6.9.2016 and 21.10.2016 passed in Cr. Misc.

Patna High Court Cr.Misc. No.1884 of 2017 (2) dt.19-01-2017 2/2 No.30024/16 and Cr.Misc.No.44169/16 respectively..

The petitioner has got no criminal antecedent.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender before the court below within four weeks from today be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Lakhisarai, in Lakhisarai P.S.
