JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-01-2018 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Gurua P.S. Case No. 152 of 2017 for the offences punishable under Section 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Excise Amendment Act, 2016.

The allegation of the informant is that a raid was conducted in the house of the petitioner herein and 13 liters of country made liquor was recovered.

The learned counsel for the petitioner submits that the petitioner is innocent, he has a clean antecedent and is in custody since 2.11.2017.

Considering the nature of accusation, the period of

No.62901 of 2017 (2) dt.17-01-2018 2/2 custody already undergone and the fact that the petitioner has a clean antecedent, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Special Excise Judge, Gaya in connection with Gurua P.S. Case No.152 of 2017, District Gaya.
