JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 02-12-2021 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 394 of the Indian Penal Code.

As per the prosecution case, while the informant and his staff Arun Kumar were sleeping at the Petrol Pump, three unknown miscreants riding on a motorcycle came there and snatched money from Arun Kumar and took away Rs.22,000/- from the cash box and the hard disk of CCTV installed at the petrol pump. Accused persons also assaulted the informant causing head injury.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner is not named in the FIR and his name has

Patna High Court CR. MISC. No.53457 of 2021(2) dt.02-12-2021 2/2 figured during course of investigation. No incriminating material has been recovered from the conscious possession of the petitioner. Test Identification Parade has not been carried out till date. He is in custody since 17.2.2020. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Begusarai in Barauni Police Station Case No. 11 of 2020.
