2. The petitioner seeks bail in connection with Shastri Nagar P.S. Case No. 201 of 2025 dated 23.03.2025 registered for the offences punishable under Sections 126(2), 115(2), 118(1), 118(2), 85, 3(5), 61(2) of the B.N.S., 2023 and Section 3⁄4 of the D.P. Act.

3. As per the prosecution case, the petitioner and other co-accused persons are alleged to have tortured the informant due to non-fulfilment of additional demand of Rs. 20,00,000/- as

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner neither demanded any dowry nor tortured the informant. It is further submitted that the petitioner is the husband of the informant and he has no concern with the alleged offence. It is further submitted that there is no allegation of causing any cruel act against the petitioner. It is further submitted that both the incidents took place in Hyderabad, hence, the informant has no territorial jurisdiction at Patna in the present case. It is further submitted that she falsely made the story against the petitioner who poured hot water on her thigh.

It is further submitted that the petitioner caused injury in her eyes but from perusal of the materials, it appears that the cause of injury is because of rubbing of eyes due to itching and the informant has falsely made accusation against the petitioner. It is further submitted that the occurrence took place between the year 2023-2024 and the case has been registered in the year 2025 and prior to the present case, no any complaint/F.I.R. has been lodged by the informant against the petitioner and the prosecution has not explained for delay in lodging the F.I.R.

Patna High Court CR. MISC. No.41909 of 2025(2) dt.26-06-2025 3/3 granted as stated in paragraph no. 3 of the bail application. The petitioner is in custody since 30.04.2025.

5. Learned counsel for the opposite party no. 2 and learned A.P.P. for the State have vehemently opposed the prayer for bail of the petitioner. Learned counsel for the opposite party no. 2 has further stated that the petitioner caused injury on the eye of the informant. The informant also sustained injury on her thigh.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, let the above named petitioner, be enlarged on bail on furnishing bail bonds of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IX, Patna Sadar, in connection with Shastri Nagar P.S. Case No. 201 of 2025.
