The petitioners seek regular bail in connection with Barachatti P.S. Case No. 745 of 2017 for the offences punishable under Sections 30(a), 38, 47 of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 450 liters of illicit Mahua Liquor from Scorpio vehicle which was being driven by the petitioners.

The learned counsel for the petitioners submits that the petitioners are not the owner of the said vehicle, hence they have no knowledge as to what had been kept in the said vehicle, they

Patna High Court Cr.Misc. No.747 of 2018 (2) dt.18-01-2018 2/2 being only the driver of the said vehicle. It is further submitted that the petitioners have a clean antecedent and they are in custody since 26.11.2017.

Considering the nature of accusation, the period of custody already undergone and the fact that the petitioner has a clean antecedent, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned Special Excise Judge, Gaya in connection with Barachatti P.S. Case No. 745 of 2017.
