JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-07-2019 This application, for grant of anticipatory bail, arises out of Forbesganj P.S. Case No. 621/18, disclosing offences under Sections 147, 149, 341, 323, 324, 307, 379, 354(B), 504 and 506 of the Indian Penal Code. Allegation against the petitioner is of assault to the informant and specific allegation of assault is attributed to petitioner no. 2 apart from that petitioner no. 2 is accused in one more case.

Submission of learned counsel for the petitioners is that they have filed Jamabandi cancellation case, which has been decided in favour of the petitioners and out of annoyance, the informant has come out with this false case and although

Patna High Court CR. MISC. No.40669 of 2019(2) dt.02-07-2019 2/2 there is allegation of assault, however, the injury caused to the informant was found to be simple in nature which will appear form injury report except one injury, which is not legible in the injury report.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Forbesganj P.S. Case No. 621/18, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sunilkumar/- U T
