====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 20-12-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 392 and 411 of the Indian Penal Code.

The informant alleges that he was intercepted by three motorcycle borne criminals who looted his motorcycle and fled but one accused Karan was apprehended with the motorcycle of the informant and from his possession a loaded pistol with two cartridges and a mobile was recovered and he disclosed the name of the petitioner and one Boby.

Learned counsel for the petitioner submits that the

No.45044 of 2022(2) dt.20-12-2022 2/3 petitioner has antecedent of one case, it is next submitted that the petitioner was not apprehended from the spot as such nothing was recovered from his conscious possession, it is further submitted that his name transpired in the confessional statement of the co-accused, it is also submitted that the antecedent which he carries in the said case also, his name transpired in the confessional statement of co-accused but was granted bail by the learned Trial Court, it is further submitted that petitioner is a young boy aged about 21 years and is a student and presently has taken admission in Tulas institute at Dehradun and is pursuing his B.Tech.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court

Case No. 190 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. One of the bailors of the petitioner shall be his father, Ram Lal Sah.
