19-09-2016 Heard Sri Uma Shankar Singh, learned counsel for the petitioner and Smt. Indu Kumari Srivastava, learned Addl. Public Prosecutor.

The sole petitioner, apprehending his arrest in Dehri (Town) P.S. Case No. 264 of 2015 registered for offence under Sections 414, 420, 120(B)/34 of the Indian Penal Code, Sections 40 (1-a) 21 (I) of so called D.E. Act, Section 40(I) of B.M. Act and Sections 33, 41, 42 of the Indian Forest Act, 1927, has prayed for grant of anticipatory bail.

It was submitted by learned counsel for the petitioner that petitioner is the truck-owner and his truck was carrying stone chips on the basis of authorized challan and it was intercepted by the police and false case has been instituted.

Patna High Court Cr.Misc. No.39022 of 2016 (2) dt.19-09-2016 2/2 Keeping in view the nature of accusation and incorporation of certain Acts without any detail, the Court is of the opinion that it is a fit case for extending the privilege of anticipatory bail.

Accordingly, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Deepak Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Dehri (Rohtas) in connection with Dehri (Town) P.S. Case No. 264 of 2015, subject to condition as laid down under Section 438(2) of the Cr.P.C.
