JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-04-2019 This is an application for grant of anticipatory bail in connection with Piprakothi P.S. Case No. 168 of 2018, disclosing offences under Sections 147, 148, 149, 323, 307, 380, 354 of the Indian Penal Code.
Allegation against the petitioners and others is that they came variously armed and assaulted the informant and others.
Submission of learned counsel for the petitioners is that all the petitioners are ladies and there is case and counter case between the parties and injuries are simple in nature except one injury which is grievous in nature and that has been attributed to some other accused person. Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., East Champaran at Motihari, in connection with Piprakothi P.S. Case No. 168 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
