In the present writ petition, petitioner is challenging the order dated 5.12.2014 passed by the Deputy Development Commissioner, Muzaffarpur by which he has rejected the claim of the petitioner.
Petitioner has supplied computers for the purposes of
Patna High Court CWJC No.12614 of 2015 (2) dt.16-01-2017 census. Admitted dues have been paid to the petitioner but has claimed that he has not been paid the amount proportionate to the computers which has been given to the department for the aforesaid purpose. It has been stated for making proper payment he has filed an application. Learned counsel for the petitioner further submits that computers were kept by the department and for that petitioner is also entitled to the amount whereas learned counsel for the State submits that even after writing letter to the petitioner to take back the computers he has not acted upon. For disputed amount the petitioner has filed an application dated 11.12.2014 before the Deputy Development Commissioner, Muzaffarpur which is still pending. In such view of the matter, D.D.C. Muzaffarpur is directed to look into the claim of the petitioner and pass a reasoned order in accordance with law. If the petitioner would remain aggrieved of the order he will be at liberty totake legal course in accordance with law.
For convenience petitioner is directed to file a detailed application before the D.D.C. Muzaffarpur who will consider the same and pass a reasoned order in accordance with law within a period of six months from the date of filing of the
Patna High Court CWJC No.12614 of 2015 (2) dt.16-01-2017 said application.
With the aforesaid observation and direction this writ petition is disposed of.
