The petitioner apprehends his arrest in connection with Barauni P.S. Case No. 365 of 2009 registered under Sections 399 and 402 of the Indian Penal Code and Sections 25(1-B)A, 26 and 35 of the Arms Act.
Learned counsel for the petitioner submits that it would appear from the F.I.R. that 10 persons including Anil Sahni and Baidhnath Singh were apprehended by the police, who disclosed the name of this petitioner along with three others, who succeeded to flee away from the place of occurrence. Except the confessional statement, Anil Sahni and Baidhnath Singh, there is nothing against the petitioner, showing the involvement in the
Patna High Court Cr.Misc. No.53164 of 2016 (3) dt.16-12-2016 present case and the petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Begusarai, in connection with Barauni P.S. Case No. 365 of 2009, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
