The petitioner apprehends her arrest in Kotwali (Tilkamanjhi) P.S. Case No.819 of 2017 registered under Sections 363, 365, 120B, 34 of the Indian Penal Code.
The informant alleged that a new orphan child was found near camp jail. The informant and others took the child to hospital. The petitioner was on duty but on the next date when the informant went to take the child, the informant came to know that the child is missing.
The learned counsel for the petitioner submits that the child was not missing, the child was given to Manohar Kumar Singh,
Patna High Court Cr.Misc. No.63690 of 2017 (2) dt.11-01-2018 2/2 Chairman of Child Welfare Committee for proper upkeepment. The petitioner is a student of P.G. Deptt. of Pediatric and she treated the child so that the child will be handed over to the informant. But on the next date, the child was not handed over to the informant, that's why the informant lodged a case making false allegation.
Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, in the event of her arrest or surrender before the learned Court below within a period of four weeks from the date of receipt / production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhagalpur in connection with Kotwali (Tilkamanjhi) P.S. Case No.819 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Sanjeev/- U T
