The petitioner is in custody in connection with Ladaniya P.S. Case No. 163 of 2015 corresponding to S.T. No. 241 of 2018 for the offences under Sections 302/34 and 120(B) of the Indian Penal Code and section 27 of Arms Act. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 08.12.2017. He further submits that petitioner is not named in the F.I.R. The name of petitioner has surfaced in this case on the basis of confessional statement of co-accused Sukesh Kumar who has already been granted bail by this Court. Similarly placed other co-accused persons have been granted bail by this
Patna High Court Cr.Misc. No.75253 of 2018(3) dt.29-01-2019 2/2 Hon'ble Court as contained in Annexure-2.
Considering the aforesaid, the Court is inclined to grant bail to the petitioner, let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Additional District Judge-VI, Madhubani in connection with Ladaniya P.S. Case No. 163 of 2015 corresponding to Session Trial No. 241 of 2018 subject to the conditions that :-
(1) Bailors should be local having sufficient immovable property within the jurisdiction of the Court concerned.
(2) Petitioner shall co-operate in teh trial and shall be properly represented on each and every date fixed by the Court and his absence on two consecutive dates without proper and sufficient reason the trial Court will be at liberty to cancel his bail bond.
(3) If the petitioner tempers with the evidence or the witnesses of the case, in the case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
