1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The learned counsel for the petitioners seeks permission to withdraw the present anticipatory bail application with respect to petitioner no.1, namely, Murli Yadav @ Murlidhar Yadav.
3. Permission is accorded.
4. Accordingly, instant petition is dismissed as withdrawn with respect to petitioner no.1, namely, Murli Yadav @ Murlidhar Yadav.
5. The petitioner no.2 seeks bail in anticipation of his arrest in a case registered for the offences punishable under
Patna High Court CR. MISC. No.48650 of 2024(2) dt.26-07-2024 2/3 Sections 341, 323, 307, 379, 504, 506 and 34 of the Indian Penal Code.
6. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that Murli Yadav assaulted him by an iron rod causing injury on head as his uncle refused to give goods on credit.
7. The learned counsel for the petitioner submits that specific allegation of assaulting the informant is against Murli Yadav and the injury suffered by the injured is simple in nature and no specific allegation is alleged against the petitioner.
8. Learned A.P.P. opposes the anticipatory bail application.
9. Considering the submissions made by the learned counsel for the petitioner, the petitioner no.2, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1st, Bhojpur at Ara in connection with Shahpur P. S. Case No.71 of 2024, subject to the conditions laid down under Section 438(2) of the
Patna High Court CR. MISC. No.48650 of 2024(2) dt.26-07-2024 3/3 Cr.P.C.
