The petitioner apprehends his arrest in Bihta P.S. Case No. 1118 of 2018, registered for the offences punishable under Section 420 and other allied sections of the Indian Penal Code. As per the FIR, petitioner is alleged to have got the compensation money of Rs. 18,93,511/- by giving false evidence.

It is submitted that after proper verification of document provided by the petitioner amount of compensation money was given to him. Later on, a private person filed an objection before the Additional District Land Acquisition Officer, Patna disputing the title of petitioner on the acquired land. Thereafter, without any proper evaluation of documents

Patna High Court CR. MISC. No.55866 of 2021(2) dt.28-06-2022 2/2 and evidences on record he decided the title in favour of objectioner and reviewed its earlier order by order dated 28.08.2017 in LA Case No. 1/2021 and directed the petitioner to refund the compensation amount. The said order was challenged by the petitioner in the High Court, Patna by filing a writ petition vide CWJC No. 14155 of 2017 on which the Hon'ble Court after hearing the parties granted stay on recovery of the compensation amount by its order dated 30.10.2018. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.

10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Danapur, Patna in connection with Bihta P.S. Case No. 1118 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
