1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Uchkagaon P.S. Case No.329/2022, registered for the offences punishable under Sections 341, 323, 324, 307, 379, 504 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner has antecedent of four cases and the informant alleges that accused persons including the petitioner intercepted him and abused as informant's grandfather was a witness in a case instituted against the petitioner and has given evidence in Uchkagaon P.S. Case No.259/2022, thus petitioner assaulted him by farsha causing injury on head, thereafter Naushad Alam, Hazra Khatoon and Samsun Nesha assaulted him and snatched his mobile.

4. Learned counsel for the petitioner submits that

It is next submitted that even presuming what has been alleged is true without admitting then it was informant's grandfather who was a witness against the petitioner in Uchkagaon P.S. Case No.259/2022, as such there was no occasion for the petitioner to assault the informant.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner and submits that petitioner has antecedent of four cases and there is specific allegation against him of assaulting the informant by farsha causing injury on head for the reason that grandfather of the informant had given evidence as a witness in Uchkagaon P.S. Case No.259/2022 in which petitioner was an accused. It is also submitted that investigation in the case is still continuing.

6. Considering the submissions made by the learned APP, the Court is not inclined to extend the privilege of anticipatory bail to the petitioner.

7. The anticipatory bail application of the petitioner is rejected.
