JUSTICE SANJAY PRIYA ORAL ORDER 21-02-2019 Heard learned counsel for the petitioner, learned counsel for informant and learned APP for the State. The petitioner seeks bail in complaint case no. 1596C/2016 instituted for the offence under Section 498A Indian Penal Code.
In the written report, it is alleged that petitioner is thief and he used to go outside in the night to commit theft and appeared in the morning . The complainant enquired from petitioner then he gave threat to her to assault with knife. He also used to assault the complainant. Finally, the complainant was forced to leave the matrimonial house.
Learned counsel for petitioner submits that
Patna High Court Cr.Misc. No.73170 of 2018(3) dt.21-02-2019 2/2 complainant does not want to live with petitioner. It is mentioned in para 3 of bail petition that petitioner has clean antecedent. The complainant has levelled false allegation that petitioner is a thief and goes outside in night to commit theft. The petitioner is in custody since 27.8.2018. Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the J.M.1st Class, Araria, in connection with complaint case no. 1596-C/2016 subject to the condition that both the bailors shall be the close relative of the petitioner.
