The petitioner apprehends his arrest in Amdabad P.S. Case No. 72 of 2016 registered for the offences punishable under Section 376 of the Indian Penal Code and Sections 3/4 of the POCSO Act.
The informant/victim made allegation that while she had gone to attend ceremony of Bahubhoj along with Gauri Kumari and Kavita Kumari when she went to urinate behind the back of the house, this petitioner and one Chhotu Kumar kidnapped her and the petitioner is alleged to have committed rape with her.
Mr. Bimal Kumar, learned counsel for the petitioner submits that, in fact, the victim was in love with the petitioner
Patna High Court Cr.Misc. No.39530 of 2016 (2) dt.19-09-2016 2/2 from before she wrote several love letters. There was a joint photograph of the victim with the petitioner. The victim was not medically examined.
Be that as it may but the victim is a minor girl and she made allegation against the petitioner that the petitioner committed rape with her, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
