2. The petitioner seeks bail in a case registered for the offence punishable under Sections 61(2), 103(1), 351(2) (3)&3(5) of the B.N.S. and Section 27 of the Arms Act.

3. The allegation in the first information report is that one Sunil Tiwary and Saroj Ojha came armed with pistol and Sunil Tiwary fired at the son of the informant namely Akhilesh Tiwary indiscriminately due to which he fell down.

4. Learned counsel for the petitioner submits that the petitioner although named in the FIR but is not one of the assailants. His name has only surfaced in the case as amongst

Patna High Court CR. MISC. No.42938 of 2025(2) dt.11-07-2025 2/2 one of the persons who had threatened the informant earlier. Learned senior counsel for the petitioner also points out order dated 07.03.2025 passed in Cr. Misc. No. 12263 of 2025 whereby similarly co-accused Anil Tiwary, being a non-assailant has been granted bail. The petitioner having no criminal antecedent is in custody since 26.04.2025.

5. Learned APP for the State has opposed the application for bail.

6. Considering the facts and circumstances of the case, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Navanagar P.S. Case No. 295 of 2024. (Soni Shrivastava, J) devendra/- U T
