====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 16-04-2021 Heard the parties in virtual Court.

The petitioner is languishing in custody for the offence punishable under Section 30(a)/32(1)(2)(3)/4(1) Bihar Prohibition & Excise Act, 2016.

Allegation is of recovery of liquor. Petitioner has got identical allegation. It appears that some other accused were allowed anticipatory bail and the petitioner was also allowed provisional anticipatory bail till submission of the charge sheet. However, after submission of the charge sheet the petitioner surrendered on 04.03.2020 and thereafter he is in jail. Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below

Patna High Court CR. MISC. No.788 of 2021(3) dt.16-04-2021 2/2 where the case is pending in connection with Special Case No.7192 of 2019 arising out of Salimpur P.S. Case No.169 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
