The petitioner is accused in Sahiyara Police Station Case No 96 of 2017 registered for the offences punishable under Sections 392 of Indian Penal Code.
Allegation is that informant along with his brotherin-law was intercepted on his motorcycle and subjected to loot. Counsel for the petitioner submits that the petitioner is not named in the first information report and his name has surfaced on the basis of confessional statement of one accused. The same has led to no recovery. Only one mobile phone is allegedly recovered from the petitioner's house. There is one case pending against the petitioner since before which he has disclosed in the petition in which he is on bail. He is in custody in connection with this case

Having regard to the submissions made on behalf of the petitioner, prayer for bail is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Judge V, Sitamarhi in Sahiyara Police Station Case No 96 of 2017 subject to the following conditions:
(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.
(2) That the petitioner will give an undertaking that he will receive the police papers on the given date and be present on date fixed for charge and if he fails to do so on two given dates and delays the trial in any manner, his bail will be liable to be cancelled for reasons of misuse.
