The petitioner apprehends his arrest in connection with Begusarai Town P.S. Case No. 72 of 2015 for offences punishable under Sections 420, 467, 471 and 34 of the Indian Penal Code. The allegation against the petitioner is of colluding in preparation of forged documents.
While Mr. Mrigank Mouli appearing for the informant has charged the petitioner to be the brain behind the preparation of the documents, it is the argument of Mr. Suresh Prasad Singh No. 1 appearing for the petitioner that despite such accusation the petitioner's name does not even find mention in the array of the accused.
Having heard learned counsel for the parties and considering the circumstances, let the petitioner Munna Jha in the event of his arrest / surrender within four weeks from today be released on bail on furnishing bail bonds of Rs. 10,000/- (rupees
Patna High Court Cr.Misc. No.28723 of 2015 (3) dt.20-01-2016 ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in connection with Begusarai Town P.S. Case No. 72 of 2015 subject to the following conditions:
(a) One of the bailor of petitioner would be a close relative who shall file an affidavit as to his / her relationship with the petitioner and who would also file an undertaking to inform the court below in case of change of address of the petitioner;
(b) The affidavit should also accompany an undertaking on behalf of the petitioner to receive the police paper and if the petitioner fails to do so or avoids its service, the informant would be at liberty to pray for cancellation of his bail bonds;
(c) The petitioner would ensure his representation on each and every date fixed in the case before the court below and in case the petitioner fails to do so on two consecutive dates without reasonable explanation to the satisfaction of the trial court, the court below would be at liberty to take steps for cancellation of his bail bond and to take him into custody.
