2. The petitioners apprehend arrest in connection with Asarganj P.S. Case No. 160 of 2024 dated 22.11.2024, registered for the offence punishable under Sections 126(1), 115(2), 329(3), 109(1), 303(1) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. The prosecution case, in short, is that on the date of occurrence the petitioners along with co-accused persons armed with iron rod while abusing the informant entered his house and
Patna High Court CR. MISC. No.43442 of 2025(2) dt.16-07-2025 2/3 brutally assaulted him and his family members as a result of which they sustained injuries and one of the co-accused person also snatched gold chain.
4. Learned counsel for the petitioners submits that the petitioners are innocent and they have been falsely implicated in this case. It is submitted that there is no specific allegation against the petitioners, rather, the allegation against them is general and omnibus. It is submitted that there is case and counter case between the parties and the counter case has been lodged by the wife of Sadanand Yadav bearing Asarganj P.S. Case No. 163 of 2024. It is further submitted that Sadanand Yadav has also sustained injury. Lastly, it has been submitted that petitioner nos. 2, 3 and 4 have no criminal antecedent and petitioner no. 1 has one criminal case against him.
5. Learned A.P.P. has opposed the prayer for bail of the petitioners.
6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioners within a period of six weeks from today, in connection with Asarganj P.S. Case No. 160 of 2024, they shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each
