The petitioner apprehends his arrest in Islampur P.S. Case No. 117 of 2016 registered for the offences punishable under Sections 304(B) and 34 of the Indian Penal Code. The informant alleged that his daughter was married to Pradip Kumar three years ago but her husband, father-in-law and mother-in-law began to torture her. On 07.05.2016, the informant knew that his daughter was killed.
Learned counsel for the petitioner submits that the petitioner is father-in-law of the deceased. Neither the deceased nor the informant made any complaint with regard to ill-treatment at the hands of the petitioner. The deceased died due to abdominal pain. Considering the fact that the petitioner is father-in-law of the deceased and there is no specific allegation of torture against the petitioner and the marriage was solemnized about three years ago, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st Class, Hilsa, Nalanda in Islampur P.S. Case No. 117 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
