JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-06-2019 The present writ petition has been filed for directing the respondents, particularly the respondents no. 3 and 7 from restraining themselves from illegally and arbitrarily interfering in the peaceful possession of the land of the petitioner. Admittedly, the petitioner has lost the title suit filed by him for declaration of his right, title over the said piece of land inasmuch as the Title Suit No. 11 of 1995 has been dismissed by the learned Additional District & Session Judge VI, Danapur by a judgment dated 16.9.2011 and thereafter, the first appeal filed by the petitioner has also been dismissed and

Patna High Court CWJC No.7347 of 2014(7) dt.25-06-2019 2/2 then, the petitioner has preferred a second appeal before this Court bearing Second Appeal No. 653 of 2011 which though has been admitted but no stay / injunction has been granted. Having regard to the facts and circumstances of the case, I deem it fit and proper to dispose of the present writ petition with liberty to the respondents to take action in accordance with law and upon being armed with an appropriate order of a competent court of law / authority. The writ petition stands disposed of on the aforesaid terms.
