The petitioners seek bail in a case registered for the offence punishable under Sections 363, 366A, 34 of the Indian Penal Code.
Prosecution case as lodged by the informant is that
Patna High Court CR. MISC. No.39690 of 2020(3) dt.08-03-2021 2/2 my daughter aged about 14 years who studied in class 9th was gone out of house but did not return. It is alleged that petitioners along with others have kidnapped his daughter also gave threatening.
Learned counsel for the petitioners submits that petitioners are innocent and have been falsely implicated in this case. He submits that victim has not taken name of the petitioners and there is allegation upon co-accused Md. Sabir. He further submits that petitioners bear no criminal antecedent and they are languishing in judicial custody since 28.08.2020 and 12.09.2020 respectively.
In the facts and circumstances of the case, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Madhubani in connection with Harlakhi P.S.
