The petitioner apprehends his arrest in connection with Forbesganj P.S. Case No. 249 of 2016 registered under Sections 341, 323, 386, 307, 379, 504 and 506/34 of the Indian Penal Code and Section 27 of the Arms Act.
The accusation is that, in the evening of 31.05.2016, the informant was talking to his brother, Naiyar Ansari, who used to reside near College Chouck, Ward No. 10. At that time, Vikky Yadav came there and started to abuse him and made demand of ransom Rs.50,000/- and also threatened him of dire consequences. When the informant made protest then Vikky Yadav call to his associates then Mona Jaiswal, petitioner and one unknown came there. At that time, Vikky Yadav caused injury at the head of the
Patna High Court Cr.Misc. No.44529 of 2016 (2) dt.27-10-2016 informant through butt of the Postol. When brother of informant, Naiyar Ansari, rushed to save him then they also caused injury to his brother. At that time, Vikky Yadav shot fire at the informant but did not hit anyone.
Learned counsel for the petitioner submits that there is general and omnibus allegation against the petitioner and others to cause injury to the brother of the informant. Moreover, the injury caused to the informant and his brother is simple in nature and petitioner has no criminal antecedent.
Considering the aforesaid submissions, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria, in connection with Forbesganj P.S. Case No. 249 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
