2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) of Bihar Prohibition and Excise Act.
3 . Total 45 liters of Nepali liquor was recovered from the seized motorcycle .
4. It is submitted that the petitioner is innocent and has falsely been implicated in this case only on the basis of suspicion . Petitioner is neither owner nor driver of the seized vehicle . No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery . Petitioner has got 1

5 . Learned counsel for the State opposes the bail petition .
6. Considering the fact that aforesaid facts and other circumstances of the case , in the event of arrest/surrender within eight weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive special Judge Excise Court Madhubani in connection with Harlakhi Police Station Case No. 318 of 2022 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 .
