The petitioner seeks bail in a case registered for offences under Sections 272 and 273 of the Indian Penal Code and Section 30 (a) (d) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 30 litres of country made liquor was recovered from the house of the petitioner but nothing was recovered from the conscious possession of the petitioner. It is urged that the petitioner has remained in custody since 19.09.2017, i.e., for about more

Considering the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cumSpecial Judge, Excise Act, Sitamarhi in connection with Bajpatti P.S. Case No. 231 of 2017 (G.R. No. 931 of 2017) with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
