The application is for grant of anticipatory bail for the offence under Sections 341, 323, 504 and 406/34 of the Indian Penal Code.

The allegation against the petitioner is that he assaulted the informant with iron rod.

It is submitted on behalf of the petitioner that so far allegation of assault with Bhala is concerned, that is against the co-accused Laddu Verma, who has been granted anticipatory bail by the court below and the allegation against the petitioner is of assault with iron rod and the injury is simple in nature. Heard learned A.P.P. also.

In view of the fact that the allegation of assault against the petitioner is simple in nature as well as the co-accused, Laddu Verma, has already been granted anticipatory bail by the court below itself, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of ACJM, Danapur, Patna in connection with Bihta P.S.Case No.496 of 2016, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
