Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the state.
The petitioner seeks bail in connection with Phulparas P.S. Case No. 132 of 2018 (G.R. No. 892 of 2018), registered under Sections 147, 148, 149, 341, 506 and 307 of the Arms Act and 27 of the Arms Act.
The accusation is that informant, Bisheshwar Yadav, was in way of his house, at that time of, eleven persons, named in the first information report, including the petitioner, variously armed with weapons stopped him. When informant made protest, then, all started making firing. At that time, firing of the
Patna High Court CR. MISC. No.2478 of 2021(2) dt.17-02-2021 2/2 petitioner hit near the left eye of the informant. Submission is that earlier the prayer of the bail of the petitioner was refused, on merit, vide Cr. Misc. No. 657333 of 2019 on 24.02.2020 for the present. The petitioner is in custody since about two years.
Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Phulparas P.S. Case No. 132 of 2018 (G.R. No. 892 of 2018) to the satisfaction of the Additional Chief Judicial Magistrate, II, Jhanjharpur, Madhubani.
