====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-08-2025 Heard learned counsel for the petitioners and the State.
2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 115(2), 126(2), 303(2), 352, 351(2) and 3(5) of the Indian Penal Code.
3. As per the prosecution case, all the FIR named accused persons including these petitioners abused and assaulted mother of the informant by means of lathi alleging that she was a Dayan. Accused persons also snatched gold chain from the brother of the informant
4. It is submitted on behalf of the petitioners that
Patna High Court CR. MISC. No.49561 of 2025(2) dt.06-08-2025 2/2 parties are co-villagers and due to dispute over pathway, this case has been lodged against these petitioners with false allegations. Doctor has found simple injury. Petitioners claim clean antecedent.
5. Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within eight weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada in Nawada Police Station Case No. 252 of 2025, subject to the conditions laid down under section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
