Petitioners are apprehending their arrest in a case registered for offences punishable under Sections 147, 149, 341, 323, 504, 506, 308, 380 and 447 of the Indian Penal Code. It has been submitted on behalf of the petitioners that save and except general and omnibus allegations of marpit, no specific overt act has been attributed to these petitioners and now the parties have also compromised the matter.

Heard learned A.P.P. also.

Having heard both sides and in view of the fact that

Patna High Court Cr.Misc. No.49662 of 2016 (2) dt.19-12-2016 2/2 general and omnibus allegation of free fight has been levelled against the petitioners and the injuries caused to the informant, are simple in nature and also that the petitioners have no criminal antecedent, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within a period six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Hajipur Sadar P.S. Case No. 569 of 2014, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
