JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-10-2016 Heard learned counsels for the petitioner and the State The petitioner being the widow mother-in-law of the deceased is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 307, 306 and 498(A)/34 of the IPC and 3/4 of the Dowry Prohibition Act. The prosecution case is that on 27.12.2015 at 1 P.M. the informant Bebi Devi, whose marriage was solemnized with coaccused Ashok Kumar Yadav, four years prior to the occurrence, was sitting at her house. In the meantime, the accused persons including the petitioner came and started hurling abuses for nonfulfilment of dowry demand of motorcycle. Her husband Ashok Yadav along with other accused persons poured kerosene oil on the informant and set her on fire causing serious burn injuries to

Patna High Court Cr.Misc. No.28036 of 2016 (4) dt.03-10-2016 2/2 her. Thereafter all the accused persons flee away leaving her in the house and thereafter informant's brother nephew Santosh Yadav came and with the help of other people brought her to Sadar Hospital for treatment.

It is submitted by learned counsel for the petitioner that the victim put herelf on fire. The specific accusation has been levelled against the husband of the deceased and the chargesheet against him has been submitted under Section 306 of the IPC. Considering the specific accusation against the husband of the deceased and chargesheet being submitted only under Section 306 IPC against the husband of the victim, let the above named petitioner be released on anticipatory bail till the conclusion of the investigation, in the event of arrest or surrender before the learned court below within a period of 12 weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-XIII, Gopalganj in Fulwaria P.S.Case No.168 of 2015, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
