JUSTICE SHIVAJI PANDEY ORAL ORDER 07-01-2015 It appears that as the petitioner is challenging the interim order dated 24th August 2013 arising from Maintenance Case No. 55 of 2012 which is in the nature of interim order, in terms of Section 397 sub-clause(2) of the Criminal Procedure Code the revision does not lie against the interim order. In that view of the matter, this Court feels that the petitioner should change the cause title under the proper heading within two weeks.

Let the Authority deduct Rs. 3,500/- (three thousand five hundred) from the salary of the petitioner and that should be remitted to opposite party No. 2.

If the petitioner makes necessary correction, the Office is directed to provide the case number without any delay. As it is a matter of 2013, let the notice be issued to

Patna High Court CR. REV. No.317 of 2014 (6) dt.07-01-2015 2/2 opposite party No. 2 under registered cover with A/D as well as through ordinary process for which requisites etc. must be filed within one week after proper correction, failing which this petition as against her shall stand rejected without further reference to a Bench.

In the meantime, order dated 24th August 2013 passed by the Principal Judge, Family Court, Ara, Bhojpur in Maintenance Case No. 55 of 2012 will remain stayed. After the appearance of O.P. No. 2 the case will be listed at the top of list. (Shivaji Pandey, J) Mahesh/- U T
