JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-02-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Taking into consideration that petitioner happens to be main assailant, I do not find any new ground to reconsider the prayer for bail of the petitioner, accordingly, his prayer for bail in connection with Kusheshwar Asthan P.S.Case No. 167 of 2013, pending in the court of Sub-Divisional Judicial Magistrate, Benipur, Darbhanga stands rejected.

However, learned Sub-Divisional Judicial Magistrate, Benipur, Darbhanga is directed to commit the case of the petitioner to the court of session as early as possible, if the same has not been committed as yet.
