JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 27-01-2016 By way of the present application preferred under Articles 226 and 227 of the Constitution of India, the petitioner seeks following relief:

"1.that the petitioner seeks indulgence of this Hon'ble Court for the following reliefs:- (i) To issue a writ in the nature of Certiorari or any other appropriate relief/s quashing the First Information Report of Saharsa Sadar P.S. case no.112 of 2005 qua the petitioner.

(ii) To issue a writ in the nature of Certiorari for quashing the order dated 13.11.2014 by which the Learned Chief Judicial Magistrate, Saharsa, has been pleased to issue Warrant of arrest, Non

Patna High Court Cr. WJC No.344 of 2015 (2) dt.27-01-2016 2/2 bailable against the petitioner.

(iii) For any other relief/s for which the petitioner is found entitled to."

After some argument, learned counsel for the petitioner seeks leave to withdraw the present application in order to raise all the points available to the petitioner, in case an adverse police report under Section 173 of the Code of Criminal Procedure is submitted against him in the court.

Leave is granted.

The application is dismissed as withdrawn.
