The petitioner apprehends his arrest in connection with Sahebganj P.S. Case no. 320 of 2018, registered under Sections 406, 419 and 420/34 of the Indian Penal Code.

The accusation is that in course of inspection of L.B.S. Pvt. Industrial Training Institute, Tilaiya Patti / Telia Chhapra run by Manager Ajay Singh (Petitioner) of whom the trustee is Ajay Singh in which Shambhu Sharan, Principal, was found engaged in taking admission for Session 2018-20 of total ten students receiving Rs.10,000/- , each, saying that Rs.30,000/- will be taken later on. On inquiry and verification, it was detected that the application has already been

Patna High Court Cr.Misc. No.73675 of 2018(4) dt.04-02-2019 2/3 submitted to DGET, Delhi for recognition, but the recognition has not been accorded. It is alleged that in previous session also admission was also taken regarding five students. Chanchal Kumar, Vivek Kumar, Navneet Kumar and Ankur Kumar, who were present there for taking their admission also stated that they were informed that recognition has been granted and the classes will be run from 01.09.2018. Learned counsel for the petitioner submits that while L.B.S. Pvt. Industrial Training Institute, Tilaiya Patti / Telia Chhapra was at the opening stage and some gratification was demanded and application was also submitted for recognition for coming session, but with ulterior motive the present case has been lodged. Moreover, the Principal of the said institute has already been allowed privilege of bail vide Criminal Miscellaneous No. 66696 of 2018 on 01.11.2018. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M-I, West
