The petitioner No.1, who is father -in-law and petitioner No.2, mother-in-law of the deceased seeks regular bail in connection with K.Asthan P. S. Case No. 190 of 2017, registered for offences punishable under Sections 498A, 302 and 34 of the Indian Penal Code.

The prosecution case as lodged on the basis of written report by the informant is that the marriage of his daughter Sulekha Devi was solemnized with the son of the petitioners and they used to torture her for non fulfillment of dowry and ultimately hey killed her and thereafter they tried to conceal the dead body

Learned counsel for the petitioners submits that the post mortem report of the deceased reveals that the death of the deceased was due to intracranial hemorrhage compression and shock and entire allegation against the petitioners are general and omnibus in nature. It is further submitted that the petitioners are in custody since 16.10.2017 and 08.11.2017, respectively. Considering the facts and circumstances and the materials on record, let the petitioner No. 2, Ram Dai Devi, who is in custody since 08.11.2017 be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sri Kumar Sudhanshu, Judicial Magistrate, 1st class, Biraul at Benipur, Darbhanga in connection with K. Asthan P. S. Case No. 190 of 2017. The prayer for bail of the petitioner No.

1, Prabhu Ram stands rejected at this stage in connection with K.Asthan P.S.Case No. 190 of 2017 pending in the Court of Shri Kumar Sudhanshu, Judicial Magistrate 1st Class, Biraul at Benipur, Darbhanga. The petitioner No. 1 is at liberty to renew his prayer for bail after six months.
