Having regard to the fact that the impugned order passed by the Collector was also implemented in the sense that a fresh selection process was undergone in the year 2014, this Court is not inclined to now examine the correctness of the order of the Collector. There would be also of course no reason for this Court to even go into the fresh selection because the petitioner herself did not participate in the fresh selection.

Thus, for the reasons indicated above, this application must fail and is hereby dismissed.

Patna High Court CWJC No.6352 of 2008 (5) dt.29-07-2015 Nothing said in this order, however, will come in the way of the petitioner in raising the matter relating to alleged illegality in the selection held in the year 2014 before the competent authority.
