This is an application for bail in connection with Laukariya P.S.Case No. 69 of 2017 registered for the offences punishable under Sections 25(1-B)(a), 26 of the Arms Act, 3/ 4 of Explosive Substance Act and 16, 17, 18, 20, 22, 23 of UAP Act. Allegation against the petitioner is of recovery of one loaded country made pistol and four detonators and he is accused in five other cases.
Submission of learned counsel for the petitioner is that though he was arrested on 2.7.2017 but produced before the court on 6.7.2017 and he has falsely been implicated in this case and nothing has been recovered as alleged in the FIR. Heard learned APP also, who has opposed the prayer for
Patna High Court Cr.Misc. No.54988 of 2017 (2) dt.20-11-2017 2/2 bail.
Having heard both sides and considering the facts and circumstances of the case and having criminal antecedents, I am not inclined to grant bail to the petitioner. However, learned trial court is directed to expedite the trial and try to conclude it within a period of six months. If trial is not concluded not at the fault of the petitioner within the said period, trial court shall release the petitioner on bail to its own satisfaction with an undertaking by the petitioner that he will cooperate in trial and appear in court on each and every date except showing any genuine reason.
