JUSTICE SANJAY KUMAR ORAL ORDER 19-12-2017 Heard learned counsel for the petitioner as well as learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Bhagwanpur P.S. Case No.112 of 2016 registered for the offences punishable under Sections 364, 365 and 120(B) of the Indian Penal Code.

It is alleged that the grand-parents of the informant have been kidnapped at the instance of one Sandesh Singh and other accused persons because of land dispute. The grand-parents of the informant have not yet returned. It has been submitted that the petitioner is not named in the F.I.R. but his name has been disclosed by one of the co-accused Raju Mahto, who has been allowed bail by one of the coordinate Bench of this Court in

Patna High Court Cr.Misc. No.60573 of 2017 (3) dt.19-12-2017 Cr.Misc. No.28697 of 2017 on 31.08.2017. The other co-accused Sharwan Kumar and Laljit Pasi @ Laljee Pasi have also been allowed bail in Cr.Misc.No.38322 of 2016 and Cr.Misc.No.52452 of 2017 by one of the coordinate Bench of this Court on 28.10.2016 and 04.12.2017 respectively. The case of the petitioner stands on similar footing and he is in custody since 06.09.2017. The learned A.P.P. for the State opposed the submission. Considering the facts and circumstances of the case, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of the learned A.C.J.M.-V, Kaimur (Bhabua) in connection with Bhagwanpur P.S. Case No.112 of 2016, subject to the condition that one of the bailors should be close family members of the petitioner.
