The petitioner is languishing in custody in a case registered for the offences punishable under Sections 341, 323, 498(A), 494, 308, 34 of the Indian Penal Code.

The accusations are of torture for nonfulfillment of the dowry demand, ousting the informant from her matrimonial house and performing second marriage.

It is submitted by learned counsel for the

Patna High Court CR. MISC. No.44947 of 2023(2) dt.24-07-2023 2/2 petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is husband of the informant. The marriage was performed in the year 2008 and out of the wedlock, two children were born. The petitioner has not performed second marriage and he is still ready to keep the informant as wife with full dignity and honour. The petitioner is languishing in custody since 15.03.2023.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Turkauliya P.S. Case No. 325 of 2023.
