====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 14-12-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 420, 464 and 471 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that petitioner being a Revenue Karmchari submitted a false report showing one Shyam Sundar as Raiyat holder with regard to a temple land based on which the accused has mutated their names.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is

No.44036 of 2022(2) dt.14-12-2022 2/3 next submitted that the petitioner being Revenue Karmchari had submitted a report based on the documentary evidence that the land in question was in the name of the Shyam Sundar, it is next submitted that petitioner being a government official is well aware of his responsibility that he will have to face departmental proceeding and even his service can be terminated if the allegations are found true, thus no government official without verifying the document would submit any report. It is further submitted that the management of the temple is claiming the land but in reality the land belongs to Shyam Sundar. It is also submitted that in the event if the informant is aggrieved by the action of the petitioner then in that event he has a remedy available in civil law.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is
