The petitioners seek bail in anticipation of his arrest in connection with Koilwar P.S. Case No. 263 of 2021, instituted for the offences under Section 379/34 of the Indian Penal Code, Rule 11, 56(i) of Bihar Mineral (Concession Prevention of Illegal Mining Transportation and Storage Rule) 2019, Section 15 of Environment Protection Act, 1986 and Section 21 MMDR Act, 1957.

Taking into consideration the nature of allegation under Section 56(i) of Bihar Mineral (Concession Prevention of

Patna High Court CR. MISC. No.53577 of 2021(2) dt.18-02-2022 2/2 Illegal Mining Transportation and Storage Rule) 2019 as well as and taking into consideration the marks of ditch 90'x30'20' found in possession of the petitioner which caused loss of huge amount of Government revenue and damaged the environment by said illegal work, I am not inclined to grant bail to the petitioners, therefore, the prayer for bail of these petitioners is dismissed.
