JUSTICE BIRENDRA KUMAR ORAL ORDER 08-12-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State as well as learned counsel for the informant.
The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 406, 420, 504, 506 of the Indian Penal Code and Section 138 of the Negotiable Instrument Act.
The main allegation is against the father of the petitioners with whom transaction was drawn. There is no allegation against the petitioners in the F.I.R. However, warrant has been issued against the petitioners also on the prayer of the police.
Patna High Court Cr.Misc. No.53154 of 2016 (2) dt.08-12-2016 Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sasaram, Rohtas/Successor Court in connection with Nokha Police Station Case No. 63 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
