04-12-2017 Heard Sri Kamla Kant Pandey, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 20-09-2017 in Dehri (Indrapuri) P.S. Case No. 733 of 2017 registered for offence under Section 414 of the Indian Penal Code and Sections 30 (a), 34 of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail.
At the outset, learned counsel for the petitioner has drawn my attention to statement made in paragraph - 3 of the petition to show that petitioner is having clean antecedent. It has further been argued that on false accusation of recovery of about 10 liters of country-made liquor, being carried on Hyundai car of the petitioner, the petitioner has been made accused and he is in custody since 20-09-2017.
Patna High Court Cr.Misc. No.56560 of 2017(2) dt.04-12-2017 2/2 Considering the nature of accusation, clean antecedent as well as period of custody, let the petitioner namely Pappu Kumar @ Pappu Kumar Singh be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge - II cum Special Court (Excise), Rohtas at Sasaram in connection with Dehri (Indrapuri) P.S. Case No. 733 of 2017.
