JUSTICE BIRENDRA KUMAR ORAL ORDER 19-01-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 302/34 of the Indian Penal Code.

The petitioner is wife of the deceased Pardeshi Sah. Pardeshi Sah had gone to his sasural and his murder was committed. The petitioners and others are under suspicion because in the past also deceased was assaulted with knife by the named accused persons.

Learned counsel for the petitioner submits that the case-diary would reveal that there was no case of earlier

Considering the materials as well as the fact that the petitioner is a female, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IX, Gopalganj/Successor Court in connection with Uchakagaon Police Station Case No.194 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
